These terms apply to the Thailand Package in addition to the DraftTakeoff Terms of Service. Where they conflict, these terms govern the Thailand Package.
1.1 The Thailand Package is a set of files (XLSX, CSV, JSON and a PDF handbook) of modelled benchmark unit rates for construction work in Thailand, for the monthly release stated at checkout.
1.2 A purchase covers the release you buy. Later releases are not included unless your order says so.
1.3 Rates are in Thai baht, exclude VAT, and use metric units.
2.1 We grant the buying organisation a non-exclusive, non-transferable licence to use the files for its own internal work, including estimates, budgets, cost plans and reports for its clients.
2.2 You may include individual rates, and figures you calculate from them, in documents you prepare for a specific project.
2.3 You may not resell, publish, share or redistribute the files, or any substantial part of the data, whether in its original form or in a database, price book, software product or service. You may not use the data to build a competing data product.
2.4 Any number of the buying organisation's own staff may use the files. Contractors and clients of the organisation may not receive the files themselves.
3.1 Rates are derived from Thai government publications. No Thai government agency publishes, reviews or endorses this product.
3.2 Use these rates for early estimates, budgets and checks. Do not use them as a tender price or to value a contract without pricing the work from current quotations.
3.3 Rates are national figures. Location, access, quantity, programme and market conditions move real prices.
3.4 Where an item states a quantity condition, such as a minimum number of piles, the rate applies only within it. Outside it, obtain a price for the work.
3.5 Low and high values, offer rates and budget figures are produced by our model. They are not quotations, official reference prices or market prices.
4.1 We check every release against its sources before publishing it, but we provide the data "as is". We do not warrant that it is complete, error-free or fit for any particular purpose.
4.2 You are responsible for checking scope, specification and current prices before relying on any rate.
5.1 To the extent the law allows, our total liability arising from the Thailand Package is limited to the amount you paid for the release concerned.
5.2 We are not liable for loss of profit, loss of contract, or any indirect or consequential loss, including loss arising from a tender, bid or contract priced using the data.
6.1 If you report an error that we confirm, we will correct it in the next release and tell buyers of the affected release by email.
7.1 Until you first download a file, you may ask for a full refund and we will give it. When we refund, the download links stop working.
7.2 Because the files can be kept once downloaded, we do not refund a purchase after the first download, except where a file is faulty and we cannot fix it within 14 days of your report. In that case we refund the price you paid for that release.
8.1 The Thailand Package is sold to organisations outside Thailand. If the billing country given at checkout is Thailand, or is not given, we cancel the order and refund it in full.
9.1 These terms are governed by the law of Thailand, where the service is operated, as the DraftTakeoff Terms of Service are. Your purchase from Polar is governed by Polar's own terms.
